Which products are covered?

Our Limited Lifetime Warranty (our "Warranty") extends to Bags, Briefcases and Backpacks (our “Products”) manufactured by Stuart and Lau, Inc. (hereinafter referred to just as “Stuart & Lau”) and purchased directly from Stuart & Lau with this Limited Lifetime Warranty advertised at the time of purchase.

What is covered?

Stuart & Lau Products are covered by a Limited Lifetime Warranty that protects them solely against a manufacturer’s defect that significantly impairs the intended use and functionality of the Product for the useful life of the Product.

This Warranty extends only to Products sold directly by Stuart & Lau on our website (www.stuartandlau.com) with the Warranty advertised on the product page of the product purchased. 

This Warranty does not cover your Product if you did not purchase directly from our website or if the Warranty was not advertised on the website's Product Page where it was originally purchased. 

This Warranty explicitly does not cover any fair wear and tear that occurs through the use of the Product. Please refer to the section below for more information about what is not covered by this Warranty.

What is the effective date and validity period, and can the warranty be transferred?

This Limited Lifetime Warranty is effective on all covered products purchased from 01-January-2018 onwards. Products purchased prior to that date did not have a warranty advertised and are not covered by this Warranty.

This Warranty extends only to the original purchaser of a Product. All warranties are valid only for the period of time the Product is owned by the original purchaser of the Product. The “original purchaser,” for the purposes of this warranty, is the first purchaser of the Product from Stuart & Lau. This Warranty is not transferable.

Please retain your receipt as proof of original purchase.

What is not covered?

Please read this section carefully, as it details clearly what is not covered by the Warranty:

Any and all forms of expected fair wear and tear that occur through the normal use of the Product, including but not limited to: scratches, rips, scrapes, rub marks, abrasions, frays, cuts, chips, dents, creasing, puckering, holes, tears, loose threads, de-lamination, peeling, stains, fading or discolorations over time. For the purposes of clarity, any and all fair wear and tear is not covered by this Warranty.

Damage that is cosmetic, superficial, or non-structural.

Damage that is caused by the lining or a foreign object catching in the zipper, or damage to the zipper caused overly forceful use.

Damage that occurs from the items stored inside the product or the manner in which they are stored, such as but not limited to devices, pens, keys, scissors, pocket knives, computers, cases, batteries, sharp or heavy objects, containers holding food or liquids, shoes or soiled clothing. For the purposes of clarity, any damage of any kind that is caused by foreign objects stored inside the bag is not covered by this Warranty.

Damage that occurs through the improper use, maintenance, washing, or cleaning of the Product as well as damages that are the result of attempted self-repair or user error. 

Replacement of any non-defective parts in the Product. For example, if only one component in your Product is defective, will only replace the defective part.

Product sold "on sale" "discounted" "retiring" "final sale" "clearance" “as-is”, “preconditioned”, "refurbished", “reconditioned”, “used”, “sample sale”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer, or is being sold at a deep discount to the currently stated full retail price.

All Products listed as "Retiring" or "Archive" or "Clearance" are not covered by this Limited Lifetime Warranty.

Any Product sold by a third party vendor, retailer, store, or website that is not Stuart & Lau is not covered. Likewise, any product sold by an unauthorized party such as re-sellers or second hand dealers.

Accessories, Dopp Kits, Tech Kits, Wallets, Passport Holders, Card Holders, Umbrellas and any other products that are not Bags, Briefcases, or Backpacks are not covered by this Warranty.

What happens in the event of a defect?

In the event of a Defect, Stuart & Lau’s sole and exclusive liability and your sole remedy under this limited warranty will be, at Stuart & Lau’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below.

Replacement Product may be provided in a color or model different from the Product you originally purchased.

Your Responsibilities as the Holder of This Warranty in the event of a Defect and in order to get the benefit of this limited warranty, you must return your Product to Stuart & Lau and provide Stuart & Lau with proof of the original date of purchase. Should shipping costs be required to return your Product, you will be responsible for those costs. Stuart & Lau will repair or replace (as applicable) and ship your Product or Replacement Product back to you within approximately 90 days of receiving your original Product.

Replaced or Repaired Products are not covered by this Limited Lifetime Warranty.

Disclaimer, Limitation on Liability

TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, THE PRODUCT IS PROVIDED “AS IS” AND THIS WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY, IN NO EVENT WILL STUART & LAU OR ITS SUPPLIERS BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE PRODUCT OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF STUART & LAU HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. STUART & LAU’S TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT GIVING RISE TO SUCH LIABILITY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Dispute Resolution

In the event a dispute arises between you and Stuart & Lau arising out of this Limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”). More information about the AAA is located at www.adr.org, or you can call the AAA at 1-800-778-7879. You must seek arbitration for disputes arising out of this Limited Warranty prior to exercising any rights or seeking any remedies created by the Title I of the Magnuson Moss Warranty Act. If you choose to pursue any rights and remedies that are not created by Title I of the Magnuson Moss Warranty Act, then arbitration is not required. Arbitration will take place in Wilmington, Delaware. The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. If the two arbitrators cannot agree on the third arbitrator, then the AAA will appoint the third arbitrator. Barring extraordinary circumstances, the arbitrators will issue their decision within 120 days from the date the third arbitrator is selected by the two designated arbitrators or appointed by the AAA. The arbitrators may extend this time limit for an additional 30 days in the interests of justice. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

Governing Law

This limited warranty will be governed by the laws of the State of Delaware.
